great job with philly barstool. I want to know. does quitting the football team to join the cheerleading team get this kid laid? i?ve gone back and forth on whether this increases or decreases his odds.

I had my doubts at first. When I saw homeboy hopping around doing the muffled clap to ?be aggressive?, I thought for sure his getting ass days were far behind him. But as soon as they put the camera in his face and he exclaimed ?I?m having a BLAST; it?s awesome,? I knew this was the work of a man with a mastermind game plan.

There is no doubt in my mindgrapes that this kid is laying pipe on all those cheerleader skanks. Best decision the kid could make. Uhhh should I bust my ass on the football team getting hurt and tired every day with a coach spitting in my face for the CHANCE to get laid, or should I just join the cheerleading squad and go straight to the source? Easiest choice ever. The young man had an epiphany and went with his gut. Sure he probably lost a good number of his male friends, but until his male friends learn to do a split while swallowing his cock Logan really doesn?t have any use for them does he? I say laid.

EU official criticizes Israeli settlement plan (AP)

BRUSSELS ? The European Union's foreign policy chief said Tuesday that Israel's plan to build 1,100 new housing units in occupied east Jerusalem "should be reversed" since it undermines peace negotiations with the Palestinians.

Catherine Ashton told the EU parliament that she heard "with deep regret" that Israeli settlement plans were continuing and planned to take up the issue again with Prime Minister Benjamin Netanyahu when she next meets him.

"He should stop announcing them and, more importantly, stop building them," she told legislators in Strasbourg, France.

In an interview published Tuesday, Netanyahu ruled out any freeze in settlement construction, which could further raise tensions in the area following last week's Palestinian move to seek U.N. membership.

Ashton said the expansion of settlements "threatens the viability of an agreed two-state solution" proposed by the Quartet of Mideast mediators: the EU, the United States, Russia and the United Nations.

The Israeli government on Tuesday backed the construction of 1,100 new homes in occupied east Jerusalem, which the Palestinians claim as their future capital. The government said construction could begin after a mandatory 60-day period for public comment.

"This plan should be reversed," Ashton said.

Ashton said there was little hope any of the people moving into the proposed settlements would ever be able to live a full life there.

"It is wrong to get people to live in a place which, when you look at a negotiated settlement, they will probably have to move from. Actually, that doesn't make any sense to me," she told the legislators.

The Quartet is calling for negotiations to resume in a month and a peace deal by the end of 2012. Ashton said that any momentum would be immediately undermined by the east Jerusalem housing plan.

"We called for parties to refrain from provocative actions if negotiations are really going to resume and, more importantly, be effective," she said.

Such calls received international backing.

"This sends the wrong signal at this sensitive time," Richard Miron, spokesman for United Nations Special Coordinator Robert Sery, said in a statement.

Swedish Foreign Minister Carl Bildt said the plan was going in the face of plans to negotiate.

"Provocative of Israel to announce new settlements in East Jerusalem now. Clearly contrary to Middle East Peace Quartet demand," he wrote in a Tweet message.

Anyone know anything about real estate law? | Real Property ...

Question by CC: Anyone know anything about real estate law?
I was sent a certified letter from the woman who bought my house (we closed 5 months ago). She states that she is now having plumbing problems and wants me to contact her to ?resolve? the issue. They had an inspection done and had a final walk through. I know nothing about any plumbing issues with our house. Should I call her back? My sister said I should respond or it looks like I?m hiding something. My father-in-law says to ignore it. Any opinions?

Unless you had ?will pay for plumbing repairs? in your contract you are under no obligation to do anything about it. she bought the house, it belongs to her now. Plumbing and other issues are her responsibility.

I say write her a letter telling her that.

This happened to my in-laws. They sold their house and several months later the roof leaked. The new owners tried to sue my in-laws trying to get them to pay for the new roof but they lost. My in-laws didn?t have to pay for the repairs.

(AP) ? Palestinian President Mahmoud Abbas strongly suggested Saturday that he would reject a peacemaking blueprint put forward by international mediators, saying he would not agree to any proposal that disregarded Palestinian conditions for the resumption of peace talks.

Abbas, who returned to the West Bank on Saturday after submitting a statehood bid at the United Nations a day earlier, told reporters accompanying him that he was still studying the proposal by the peacemaking Quartet ? the U.S., European Union, United Nations and Russia.

But he appeared to tip his hand by saying "we will not deal with any initiative" that doesn't demand a halt to Israeli settlement construction or negotiations based on borders before the 1967 War when Israel captured land the Palestinians claim for their state.

The Quartet statement made no such demands.

Abbas dug into his positions after resisting heavy, U.S.-led pressure to abandon his bid to have the U.N. recognize a state of Palestine in the West Bank, east Jerusalem and Hamas-ruled Gaza Strip. His willingness to stand up to Washington has won him newfound respect at home, where he had been considered a lackluster leader. The unilateral bid for statehood and U.N. membership reflects deep-seated Palestinian exasperation over 44 years of Israeli occupation.

Israel has had no comment on the Quartet plan to resume long-stalled negotiations between the Palestinians and Israel, which mediators regard as the only way to establish a Palestinian state. Israeli leader Prime Minister Benjamin Netanyahu has rejected the long-standing conditions Abbas has put forth, saying talks must go forward without imposing terms.

Netanyahu opposes negotiations based on 1967 lines, saying a return to those frontiers would expose Israel's heartland to rocket fire from the West Bank. And he says the fate of settlements should be left to negotiations.

The Quartet urged both parties to draw up an agenda for peace talks within a month and produce comprehensive proposals on territory and security within three months. Mediators aspire to a final deal within a year, but similar plans have failed to produce a peace agreement in the past, and this latest proposal offered no program for bridging the huge differences that have stymied negotiations for most of the past three years.

The Quartet plan was meant to rechannel to negotiations any momentum the Palestinians would gain from their statehood application. A U.N. nod would not deliver any immediate changes on the ground: Israel would remain an occupying force in the West Bank and east Jerusalem and continue to restrict access to Gaza, ruled by Palestinian Hamas militants.

But Palestinians are hoping that any upgrade in their international status would give them more clout in any future talks with Israel.

U.N. chief Ban Ki-moon relayed the Palestinians' statehood request to the Security Council on Friday, shortly after Abbas formally submitted it. It is expected to be shot down there, either because it won't win the required support of nine of the Council's 15 members, or because the U.S. will make good on its threat to veto it. The Security Council will meet Monday to deal with the membership request, but final action is likely to take weeks or months.

Washington has been lobbying hard to muster enough support in the Council to block the statehood application so the U.S. won't have to resort to a veto ? something that would be frowned upon by the Arab world at a time when autocratic regimes are coming under assault there.

Abbas told reporters, without explaining, that he expected the Council to take action within weeks, not months. With Council support necessary to be admitted to the U.N. as a state, the Palestinians are expected to ask the U.N. General Assembly, where they enjoy broad support, to grant them a more modest status upgrade to nonmember observer state from permanent observer.

On board his plane, Abbas described himself as exhausted by the international efforts to wear him down but buoyant when he explained in a speech to the General Assembly why he had sidestepped the negotiating process that had been the cornerstone of international Mideast policy for nearly two decades.

The pressure "didn't affect our spirits to reach the target and to deliver the Palestinian message officially," he said.

Abbas noted, without elaborating, that some unspecified Arab states had also tried to pressure him to drop the statehood application.

Netanyahu, too, has been satisfied with the trip, and by the efforts of the U.S. and Western powers to resolve the longstanding conflict through talks, not international dictates.

"The hope is that the Palestinians will eventually understand that they cannot avoid entering negotiations," he told Israel's Channel 10 TV.

Talks for all intents and purposes broke down nearly three years ago after Israel went to war in Gaza and prepared to hold national elections that propelled Netanyahu to power for a second time. A last round, backed by the U.S., was launched a year ago, with the ambitious aim of producing a framework accord for a peace deal. But it broke down just three weeks later after an Israeli settlement construction slowdown expired.

Nickelback releases first singles off new CD (AP)

NEW YORK ? If Nickelback's upcoming album sounds like the band is suffering from multiple personality disorder, frontman Chad Kroeger says that's by design.

"When you listen to this record, it sounds like it could be from four different artists," Kroeger said in a phone interview on Thursday. "We always try and do the same thing: We try to do something heavier than we've ever done, more melodic than we've ever done, every single time we do this, and I think we've achieved it again."

Nickelback's seventh album, "Here and Now," is due out Nov. 21. The first two singles, "When We Stand Together" and "Bottoms Up," will debut digitally on the band's website on Thursday at 7 p.m. EDT; the songs will be available at online retailers on Tuesday, the same day the album will be available to pre-order on iTunes.

The multiplatinum, Canadian-based act is known for hits like "How You Remind Me" and "Photograph." But while Kroeger says there is stuff on the album that's "very Nickelback," there are some songs will surprise their fans.

"I think we've tried new things and explored new ideas, and I like it when people hear the songs and people say, `This doesn't sound like Nickelback, this sounds like something different for you guys,'" he said.

Nickelback's last album, the triple platinum "Dark Horse," was released in 2008, and the band went on tour for about two years to support it. Kroeger said he spent the last year decompressing: "I spent a lot of time in Mexico and I kind of cut loose for a few months there and went a little nuts, blowing off steam."

Kroeger spent much of Thursday in the studio; the band is still finishing the record. It comes out the same day his friend and collaborator Chris Daughtry's band, Daughtry, releases their new album.

Kroeger says there's no competition between the two, though.

"I want them to do very well, I hope they come out and beat everybody, so that way we can tour together and have a very successful tour," he said.

Hundreds protest in south China over land grab (Reuters)

LUFENG, China (Reuters) ? Hundreds of villagers in southern China protested on Friday over a government seizure of land, the latest outbreak of trouble in the economic powerhouse of Guangdong province that illustrates growing public anger at the practice of land grabs.

The farmers gathered outside government offices in Lufeng, a city of 1.7 million, banging on gongs and shouting: "Give us our land back." They held banners that said "return our farmland" and "let us continue farming."

Most stood by watching and there was no immediate violence or police presence. Villagers blocked roads with motorbikes and broken bricks were piled by the roadsides.

The protests over land seizures, generally carried out by private or state-linked companies but with the acquiescence of local governments, have persisted despite assurances from the government that it will address the problem.

"We call on the government to come and investigate these land grabs by the Shanwei government," said villager Zhang Jiancheng, 35, in Wukan, one of a cluster of Lufang suburbs. "Otherwise, more villagers will rise up and cause disturbances.

"We want Wen Jiabao to pay attention to our suffering," he said, referring to China's premier.

The disputes in a country where the government legally owns all land have led to protests, fights with police, imprisonment and suicides, and created a recurring headache for the ruling Communist Party which is obsessed with stability.

"We are very angry because we have no land for our livelihood anymore," said farmer Chen Hanzou, 36, standing next to the plot of seized land in Longguang village. He added that the government took away about 40 hectares.

At Wukan village, villagers held a large white banner filled with signatures, petitioning for the return of their land.

It was the third day of tensions in Lufeng. Hundreds of villagers attacked government buildings, according to a statement by the municipal government of Shanwei region, which includes Lufeng. More than a dozen police officers were injured in the clashes and six police vehicles were damaged, it said in the statement on its website late on Thursday night.

Villagers told Reuters the protests were triggered by the seizure and sale to property developers including Country Garden. The developer could not immediately comment.

GUANGDONG TROUBLES

Shanwei officials accused villagers with "ulterior motives" of inciting others to charge into the police station on Thursday afternoon by spreading rumors about police officers beating a child to death. The statement denied any civilian deaths.

But a villager from Longguang village surnamed Li told Reuters that police beat two students on Thursday, killing one of them on the spot.

"The officials here are corrupt and are colluding with the developers," he said.

Four people were detained for organizing the protests on Wednesday, Shanwei's local news service said on its website.

"We must be united," said wheelchair-bound villager Li Shicao. "If we're scared, they'll sell all the rest of our land."

It was the latest flareup of violence in Guangdong. Earlier this year, in the factory town of Zengcheng, thousands of migrant workers rioted over the alleged maltreatment of a female worker, torching government offices, smashing police cars and marching in their thousands through the streets.

Protests and incidents of "mass unrest" have risen recently, fueled by rapid economic transformation, according to Zhou Ruijin, a former deputy editor-in-chief of the People's Daily, writing in current affairs magazine, "China through the Ages."

Between 1993 and 2006, the number of recorded "mass incidents" like riots and protests grew from 8,708 to about 90,000, Zhou wrote in the magazine's September edition. From 2007 to 2009, the number of incidents was consistently above 90,000, he added.

"By and large, the authorities have failed to prevent ... incidents of social unrest from multiplying," said Nicholas Bequelin, a senior researcher in the Asia division of Human Rights Watch. "The root cause in the countryside is land grabs."

A message on the Internet bulletin board of the Southern Daily, Guangdong's official newspaper, says residents of Wukan village had petitioned repeatedly in 2009 and 2010 about the land disputes that triggered the riot.

"Please tell us, just who will take charge of this case?" wrote a user. "Do we really have nowhere to complain?"

MESSAGES BLOCKED

China faces a leadership transition next year, with Hu Jintao expected to retire from the Communist Party in the fall and the presidency the following March, handing the posts to anointed successor Xi Jinping.

The rising discontent over land grabs, forced demolitions and corruption has increased anxieties among officials, who are determined to defend one-party rule and make the transition to a younger generation of leaders as smooth as possible.

Authorities are wary of any spread of discontent. Searches for "Lufeng" on China's Twitter-style microblogging service Weibo were blocked, with a message saying the "relevant legal regulations" prevented displaying the results.

The unrest in one of China's most economically important provinces, with the famed Pearl River Delta "world factory" zone that accounts for around a third of China's exports, also poses a major challenge for Guangdong Communist Party chief Wang Yang.

Wang, who is expected to be promoted to China's highest ranks in the leadership transition, has called for a "Happy Guangdong" development model that evens out the economic imbalances and emphasizes social harmony.

Bequelin said China could take a carrot and stick approach to Lufeng, arresting ringleaders but paying off the villagers.

"It's a vicious system where the government rewards disruption to social stability," he said. "The protesters notice and know that ... if they make big trouble, they will have big compensation."

(AP) ? Convicted cop killer Troy Davis is scheduled to be executed Wednesday for a crime he says he did not commit.

Vigils outside Georgia's death chamber were set. Protests were planned. Davis' attorneys said he was willing to take a polygraph test if the pardons board would consider its results. And they didn't rule out filing one last legal appeal, though they know it's a long shot.

Davis is to be executed by injection at 7 p.m. for the 1989 killing of Mark MacPhail, an off-duty police officer who was working as a security guard in Savannah when he was shot dead rushing to help a homeless man who had been attacked.

Davis didn't want a last meal. He planned to spend his final hours meeting with friends, family and supporters. According to an advocate who met with him late Tuesday, he was upbeat, prayerful and expected last-minute wrangling by attorneys.

Attorney Stephen Marsh said he had asked state prisons officials and the pardons board if they would allow a polygraph test. A prisons spokeswoman said she was unaware of the request and the pardons board didn't immediately respond.

"He doesn't want to spend three hours away from his family on what could be the last day of his life if it won't make any difference," Marsh said.

Davis has received support from hundreds of thousands of people around the world, including a former FBI director, former President Jimmy Carter and Pope Benedict XVI. Some of his backers resorted to urging prison workers to strike or call in sick Wednesday, and they considered a desperate appeal for White House intervention.

The U.S. Supreme Court gave him an unusual opportunity to prove his innocence last year, but his attorneys failed to convince a judge he didn't do it. State and federal courts have repeatedly upheld his conviction.

Prosecutors have no doubt they charged the right person, and MacPhail's family lobbied the pardons board Monday to reject Davis' clemency appeal. The board refused to stop the execution a day later.

"He has had ample time to prove his innocence," said MacPhail's widow, Joan MacPhail-Harris. "And he is not innocent."

Spencer Lawton, the district attorney who secured Davis' conviction in 1991, said he was embarrassed for the judicial system that the execution has taken so long.

"What we have had is a manufactured appearance of doubt which has taken on the quality of legitimate doubt itself. And all of it is exquisitely unfair," said Lawton, who retired as Chatham County's head prosecutor in 2008. "The good news is we live in a civilized society where questions like this are decided based on fact in open and transparent courts of law, and not on street corners."

Davis supporters said they will push the pardons board to reconsider his case. They also asked Savannah prosecutors to block the execution, although Chatham County District Attorney Larry Chisolm said in a statement he was powerless to withdraw an execution order for Davis issued by a state Superior Court judge.

"We appreciate the outpouring of interest in this case; however, this matter is beyond our control," Chisolm said.

MacPhail was shot to death Aug. 19, 1989, after coming to the aid of Larry Young, a homeless man who was pistol-whipped in a Burger King parking lot. Prosecutors say Davis was with another man who was demanding that Young give him a beer when Davis pulled out a handgun and bashed Young with it. When MacPhail arrived to help, they say Davis had a smirk on his face as he shot the officer to death.

Witnesses placed Davis at the crime scene and identified him as the shooter. Shell casings were linked to an earlier shooting that Davis was convicted of. There was no other physical evidence. No blood or DNA tied Davis to the crime and the weapon was never found.

Davis' attorneys say seven of nine key witnesses who testified at his trial have disputed all or parts of their testimony.

The state initially planned to execute him in July 2007 but the pardons board granted him a stay less than 24 hours before he was to die. The U.S. Supreme Court stepped in a year later and halted the lethal injection two hours before he was to be executed. And a federal appeals court halted another planned execution a few months later.

Over the years, Davis has picked up high-profile support from a host of dignitaries and dozens of federal lawmakers. Conservative figures have also advocated on his behalf, including former U.S. Rep. Bob Barr, ex-Justice Department official Larry Thompson and one-time FBI Director William Sessions.

The U.S. Supreme Court granted Davis a hearing to prove his innocence, the first time it had done so for a death row inmate in at least 50 years. At that June 2010 hearing, two witnesses testified that they falsely incriminated Davis at his trial when they said Davis confessed to the killing. Two others told the judge the man with Davis that night later said he shot MacPhail.

Prosecutors, though, argued that Davis' lawyers were simply rehashing old testimony that had already been rejected by a jury. And they said no trial court could ever consider the hearsay from the other witnesses who blamed the other man for the crime.

U.S. District Judge William T. Moore Jr. sided with them. He said the evidence presented at the hearing wasn't nearly enough to prove Davis is innocent and validate his request for a new trial. He said while Davis' "new evidence casts some additional, minimal doubt on his conviction, it is largely smoke and mirrors."

Virginia high court rules insurance companies not liable for global warming

[JURIST] The Virginia Supreme Court [official website] ruled [opinion, PDF] Friday that the effects of global warming [JURIST news archive] are not covered by a standard liability insurance policy. The AES Corporation [corporate website], a power company, is facing a suit, Kivalina v. Exxon Mobil Corp., for its contributions to global warming. AES expected that its insurance company, Steadfast, would defend this suit as part of their liability coverage. The Virginia Supreme court ruled that they are under no duty to do so, due to no single "accident" or "occurrence" forcing the suit, but intentional actions.
We have held that an "accident" is commonly understood to mean "an event which creates an effect which is not the natural or probable consequence of the means employed and is not intended, designed, or reasonably anticipated." Kivalina alleges that AES intentionally released tons of carbon dioxide and greenhouse gases into the atmosphere as part of its electricity-generating operations. We have held that "[a]n intentional act is neither an 'occurrence' nor an 'accident' and therefore is not covered by the standard policy." ... If a result is the natural and probable consequence of an insured's intentional act, it is not an accident. However, even though the insured's action starting the chain of events was intentionally performed, when the alleged injury results from an unforeseen cause that is out of the ordinary expectations of a reasonable person, the injury may be covered by an occurrence policy provision. In such a context, the dispositive issue in determining whether an accidental injury occurred is not whether the action undertaken by the insured was intended, but rather whether the resulting harm is alleged to have been a reasonably anticipated consequence of the insured's intentional act. Thus, resolution of the issue of whether Kivalina's Complaint alleges an occurrence covered by the policies turns on whether the Complaint can be construed as alleging that Kivalina's injuries, at least in the alternative, resulted from unforeseen consequences that a reasonable person would not have expected to result from AES's deliberate act of emitting carbon dioxide and greenhouse gases.
The Kivalina v. Exxon Mobil Corp. appeal was filed in the US Court of Appeals for the Ninth Circuit [official website] in November 2009 after a district court's dismissal [opinion text] on standing. The district court ruled that, being a political question, the courts could not intervene. Kivalina, an Alaskan village, is alleging that their village is being destroyed due to rising sea levels, a consequence of global warming.

In July, the UN Security Council [official website] made its first official statement [JURIST report] implicating climate change as a serious threat to world peace and security. At the urging of Germany, which released a Concept Note [text] to lead the discussion, the Security Council debated global warming for the first time since 2007. The US Supreme Court [official website] ruled [JURIST report] in American Electric Power Co. v. Connecticut [Cornell LII backgrounder] that the Environmental Protection Agency (EPA) [official website] and the Clean Air Act [text] displace claims made under the federal common law of nuisance regarding whether electric utilities contributed to global warming. All eight justices agreed in rejecting the claims by eight states, New York City and three private land trusts invoking the federal common law for public nuisance against four power companies and the Tennessee Valley Authority (TVA) [official website]. The plaintiffs sought to control greenhouse gas emissions by creating a annually declining cap on emissions. The court held that to challenge greenhouse gas emissions the plaintiffs may file petitions for rulemaking with the EPA to set emissions standards. Currently, the EPA is undergoing rulemaking on the issue and is set to issue new standards by May 2012.

Eleven months after winning the World Series, the party's over in San Francisco.

We've already known for a few weeks that the Giants' title defense ended without a return trip to the postseason. And now there's a mutiny on the ownership level to sort through ? and those always take longer than you think, despite the 'business-as-usual' claims to the contrary.

The good news is the Giants reside in the National League West, where the difference between first and worst often isn't significant, and moving from one toward the other happens with regularity.

The Giants have won five games in a row entering the second-to-last weekend of the regular season, and should reach the upper-80s in victories. So it's only a short climb back to the postseason in 2012.

But there is an obvious mandate for Larry Baer, the new guy at the top (with the ownership committee's blessings, of course) after Bill Neukom was deposed after only three years: More offense on virtually the same payroll.

Through Thursday, the Giants were dead last in the National League and 29th in the majors in runs scored. They sat only seven runs ahead of the 30th-ranked Seattle Mariners ? and almost 300 runs (or just about two runs per game) behind the major-league-leading Boston Red Sox.

The Giants were 50-9 when they score four or more runs ? but the problem is, they've only done so 59 times ? or roughly once every three games. And they were 10 games over .500 despite a run differential of -8 ? which tells you their record is better than it should be.

As fortunate as things fell for them in 2010 ? Andres Torres, Aubrey Huff, Pat Burrell, Cody Ross, to name a handful ? they went the other way this season.

A year ago at this time, the Giants were on their way to overtaking the surprising San Diego Padres. But when they arrived in Coors Field on Thursday for a weekend series, Brian Wilson threw live batting practice for the first time in his rehab from an elbow injury, while Buster Posey (knee), Jonathan Sanchez (ankle) and Nate Schierholz (foot) were in various stages of rehab at the club's Scottsdale, Ariz., training facility.

Manager Bruce Bochy isn't about to play the injury card as the main reason why the Giants are looking up at the Arizona Diamondbacks. But Neukom did in his farewell meeting with the media: "But for an unbelievable combination of injuries, this team that we built to win the division this year would have won the division.''

Still, it's not enough to expect significant offensive improvement in 2012 with the returns of Posey and Freddy Sanchez from season-ending surgeries ? plus the expected development of Brandon Belt (who, by the way, needs to be installed at first base, and allowed to grow).

There's no way of knowing if Posey can/will return to his 2010 NL Rookie of the Year level offensively, and Sanchez hasn't played more than 111 games in a season since 2008, and will play next season at age 34.

So, as adamant as general manager Brian Sabean has been about not trading Jonathan Sanchez, it's time for that to happen. Really, for the no-hitter and all that supposed promise, Sanchez is 28, and has a 38-46 record and 4.26 career ERA despite pitching in a pitcher's park.

Trading him after last season would have been optimal. But it's not too late to get a quality offensive player ? preferably a shortstop or center fielder and top-of-the-order hitter.

Face it, the Giants got a gift this season in Ryan Vogelsong. He wouldn't sign with the Dodgers, who wanted him. Instead, he returned to the Giants after time in Japan and a season in the minors, walked into camp with little chance of making the team, then turned into an All-Star and 11-game winner (with precious little run support) with the majors' best home ERA.

With the expected development of Madison Bumgarner, who just turned 22, the Giants should go with Tim Lincecum, Matt Cain, Bumgarner and Vogelsong, and like everybody else, hope for the best at the back end with Barry Zito, Eric Surkamp, somebody else from the system ? or perhaps another Vogelsong type. Getting quality arms to sign up for duty at AT&T Park shouldn't be that difficult.

But if Sabean won't go there with Sanchez, then how about parting with a reliever or two? The Padres showed the way last winter, when they sent Ryan Webb and Edward Mujica to the Marlins for Cameron Maybin, whose breakout season had him at .270 with 36 steals through Thursday.

We suggest these trade options because the bottom line in the ownership change should be apparent: the payroll isn't about to rise much, if at all. There are conflicting comments about the reasons for Neukom's forced resignation ? lack of communication, too much spending on payroll rather than putting extra cash in reserve, etc.

But it should be clear that Neukom ? a players' owner, if there is such a thing ? wasn't asked to step down because he was spending too little. As manager Bruce Bochy reflected on his relationship with Neukom: "He wanted to know everything that was going on with the club, the injuries, how we were doing.''

While the Giants' title has sparked a surge in revenues, the payroll also has risen substantially ? from about $96 million in 2010 to about $118 million this season. There will be some wiggle room with the expiring contracts of Cody Ross ($6.3 million), Miguel Tejada ($6 million) and Mark DeRosa ($5.5 million), plus Jeremy Affeldt is owed only $500,000 if a 2012 option isn't picked up.

But Cain's salary more than doubles from $7.33 million to $15.33 million for 2012, closer Brian Wilson's salary goes from $6.5 to $8.5 million, and there should be a long-term deal for Lincecum, who made $13 million this season in the last year of a two-year deal and is eligible for arbitration.

In addition, Pablo Sandoval, Sergio Romo and Schierholz will get significant raises as first-time arbitration eligibles. And the mistakes of the Magowan era still will haunt ? the $46 million remaining obligation for Zito, plus $13.6 million owed to Aaron Rowand.

So as for signing potential mega-free agents Prince Fielder, Albert Pujols, or even Jose Reyes, Baer said on Thursday: "I don't think we wake up in the morning and say that's the first choice."

In fact, don't even expect Carlos Beltran ? another impending free agent whom Bochy has called 'an impact player' ? to be back. Beltran says he will listen to what the Giants have to say this winter, but won't re-sign unless another offensive star besides himself ? and he said Reyes is the best fit ? is signed. But that's highly unlikely.
